Terms and Conditions
These Terms of Use (the “Terms”) govern your use of VSTAR Pharmacy’s web-based appointment management system, which allows you to book healthcare services at our pharmacy and other participating healthcare locations. We refer to our platform, website, and related systems collectively as the “Services.” VSTAR Pharmacy is operated by VSTAR Pharmacy Ltd. By accessing and using the VSTAR Pharmacy Services to book healthcare services, you acknowledge and agree to be bound by these Terms, establishing a contractual relationship between you and VSTAR Pharmacy. VSTAR Pharmacy may contact you regarding any transactional discrepancies, outages, or security issues.
Acceptance
Please read these Terms carefully before subscribing to or using any of the Services. These Terms constitute a legal contract between you and VSTAR Pharmacy. These Terms may be updated or amended from time to time.
Consent to the Use of Data
When you create an account and use the Services, you will be asked to provide personal or medical information. By agreeing to these Terms, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy.
Medical Advice
Your use of any aspect of VSTAR Pharmacy Services is at your own risk. VSTAR Pharmacy Services act as a communications provider connecting you to your pharmacy for healthcare appointments. We are not a healthcare provider and do not offer any medical advice. We will investigate any suspected violations of this Agreement or any illegal or inappropriate behavior. We will fully cooperate with law enforcement investigations or court orders requesting the disclosure of any individual’s identity or activities related to violations of this Agreement.
Termination
You may request the termination of your account at any time for any reason by contacting our Privacy Officer at pharmacist@vstarpharmacy.com. More information about your rights regarding your data and security can be found in our Privacy Policy. Termination of your account does not affect your obligations under this Agreement, including those obligations intended to survive the termination.
Acceptable Use Policy
Users of our Services are expected to behave responsibly and respect our staff, intellectual property, and the law. You agree to communicate with VSTAR Pharmacy team members and healthcare site staff respectfully at all times.
In addition, you must not:
- Frame or mirror any content from our Services on any other website or server.
- Post or transmit any unlawful, harmful, defamatory, obscene, profane, discriminatory, harassing, threatening, or otherwise objectionable material.
- Harvest, scrape, or collect information about others from our Services.
- Probe, scan, or test the vulnerability of the Services or breach security measures.
- Forge headers or manipulate identifiers to disguise the origin of any messages sent through the Services.
- Impersonate another individual or entity.
- Use someone’s information without their consent or provide untruthful information.
- Book an appointment and fail to attend without notifying the healthcare site.
- Create multiple vaccine reservations at different healthcare sites for a single vaccination.
VSTAR Pharmacy reserves the right to suspend or terminate your access to the Services or take other appropriate actions to address any violations of our Acceptable Use Policy or these Terms.
Account
To use the Services, you must register with VSTAR Pharmacy. You represent and warrant that you are authorized to provide all information upon registration. You are responsible for all activities occurring under your account and for maintaining the confidentiality of your account information. All information provided must be accurate. Any false information may result in the cancellation of your account and appointments, including potential legal consequences.
Safety
You are responsible for implementing all necessary safety measures to protect your well-being and property and to prevent unauthorized access or misuse of your account information. VSTAR Pharmacy is not liable for any unauthorized access or misuse of the Services or your account.
Technology Support
We do not guarantee that VSTAR Pharmacy Services will function with your mobile or computing device or be compatible with any particular hardware or software. We cannot guarantee that the Services will be error-free, timely, or secure. Information may be transmitted over a medium beyond our control; various factors may affect communications or the operation of the Services. We have no obligation to provide technical support or maintenance for VSTAR Pharmacy Services.
Third Parties
Some aspects of our site were developed in collaboration with third parties. No personal data is ever shared with any third party. Current and previous collaborators include: Inagene Diagnostic Inc., Ontario Pharmacists Association, PharmaChoice, GSK Canada, Merck Canada, and Moderna Canada. NO LIABILITY
IN NO EVENT WILL VSTAR PHARMACY LTD, ITS AFFILIATES, OR THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OR THIRD-PARTY SERVICE PROVIDERS BE LIABLE FOR ANY INCIDENTS ARISING FROM YOUR USE OF THE SERVICES, INCLUDING DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES ARISING FROM INABILITY TO USE THE SERVICES, ANY WEBSITES LINKED TO THE SERVICES, OR PERSONAL INFORMATION ACCESSIBLE ON THE SITE OR THROUGH THE SERVICES. TO THE EXTENT PERMITTED BY LAW, VSTAR PHARMACY LTD OR ANY PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES IS NOT LIABLE FOR ANY ACTION OR NON-ACTION TAKEN BY YOU IN RELIANCE ON PERSONAL INFORMATION OR CONTENT PROVIDED THROUGH THE SERVICES.
Choice of Law and Forum
This Agreement shall be governed by the laws of the province of British Columbia, exclusive of its choice of law or conflict of law provisions. You irrevocably agree to submit to the exclusive jurisdiction of the courts located in British Columbia, Canada.
Entire Agreement
This Agreement constitutes the entire agreement between you and VSTAR Pharmacy regarding the subject matter hereof. Any inconsistencies or conflicts with other materials delivered through the Services are superseded by these Terms. Modifications to this Agreement must be described herein.
Severability
If any provision of this Agreement is held to be unenforceable by a court or tribunal, such provision shall be amended or limited to the minimum extent necessary, ensuring that the Agreement remains in full force and effect.
Assignability
You agree that this Agreement may be assigned by VSTAR Pharmacy at our discretion to any third party.
Modifications of this Agreement
We reserve the right to update or modify this Agreement at any time. By continuing to use the Services after changes, you agree to adhere to and be bound by the modified Agreement. We encourage you to periodically review this Agreement.
